This Disclaimer applies to all TrainEasy offerings, including:

  • the TrainEasy mobile application, including any related features, tools, programs, content, recommendations, and functionality available through the application;
  • the TrainEasy website, store, digital programs, guides, emails, downloads, content, and other online materials; and
  • any physical fitness products, accessories, or equipment sold, supplied, or promoted by TrainEasy,

together, the “Services.”

In this Disclaimer, “TrainEasy,” “we,” “us,” and “our” refer to TrainEasy.

By using the TrainEasy app, purchasing or using any TrainEasy products, accessing TrainEasy content, or otherwise using the Services, you acknowledge that you have read and understood this Disclaimer and agree to its terms.

If you do not agree with this Disclaimer, you should not use the Services.

Nothing in this Disclaimer excludes, restricts, or modifies any rights or remedies that you may have under applicable consumer protection laws. For Australian customers, this includes rights under the Australian Consumer Law. For customers outside Australia, this may include mandatory consumer protection rights under the laws that apply in their country or region. To the extent any part of this Disclaimer is inconsistent with applicable consumer protection law, the applicable law will prevail to the extent of the inconsistency.

1. General Fitness and Recreational Use Only

The Services are intended for general fitness, recreational, educational, and informational purposes only.

The Services are not intended to be, and should not be relied on as:

  • medical advice;
  • health advice;
  • physiotherapy advice;
  • rehabilitation advice;
  • injury diagnosis;
  • treatment advice;
  • therapeutic advice;
  • professional personal training advice tailored to your individual medical condition; or
  • a substitute for advice from a qualified healthcare professional.

Any information, content, programs, exercises, instructions, recommendations, guides, product descriptions, emails, support messages, or other materials provided through the Services are general in nature.

TrainEasy does not provide medical services, healthcare services, physiotherapy services, rehabilitation services, diagnosis, treatment, or emergency health advice through the Services.

2. Not a Medical Device or Therapeutic Product

The TrainEasy app, digital content, programs, and physical products are not medical devices and are not intended to diagnose, treat, cure, prevent, monitor, or manage any disease, illness, injury, medical condition, or health condition.

You should not use the Services as a replacement for medical treatment, professional healthcare advice, or advice from a qualified practitioner.

You should not disregard, delay, or avoid seeking professional medical advice because of anything you have read, viewed, or received through the Services.

3. Use with Discretion

Your health, fitness level, mobility, experience, physical condition, injury history, and personal circumstances are unique.

Before using the TrainEasy app, starting any exercise program, following any workout, or using any physical fitness product, you should consider your own circumstances and whether the activity or product is suitable for you.

You should consult a qualified healthcare professional before using the Services, especially if you:

  • have any existing injury, illness, medical condition, pain, or health concern;
  • are pregnant, may be pregnant, or have recently given birth;
  • are under 18 years of age;
  • have been advised not to exercise;
  • have a heart condition, blood pressure condition, respiratory condition, joint issue, muscle issue, or mobility limitation;
  • are recovering from surgery, illness, or injury;
  • are taking medication that may affect your ability to exercise safely; or
  • are unsure whether any exercise, program, product, or recommendation is appropriate for you.

If you are under 18, you should only use the Services with the consent and supervision of a parent or legal guardian.

4. Safety and Proper Use

You are responsible for using the Services safely and appropriately.

You must:

  • follow all instructions, warnings, safety information, and recommended use guidelines provided by TrainEasy;
  • use proper technique and form when exercising;
  • use appropriate equipment, clothing, footwear, and training space;
  • ensure your environment is safe and free from hazards before exercising;
  • select workouts, resistance levels, weights, movements, and intensity levels appropriate for your ability;
  • stop exercising immediately if you feel pain, dizziness, faintness, chest pain, shortness of breath, unusual discomfort, or any other concerning symptom; and
  • seek medical advice or emergency assistance where appropriate.

You must not modify, misuse, damage, tamper with, or ignore safety instructions relating to any TrainEasy product or service.

5. App Recommendations and User-Provided Information

The TrainEasy app may provide exercise guidance, program suggestions, training recommendations, reminders, progress tracking, or other fitness-related content.

Any recommendations provided through the app are based on general fitness principles, app functionality, and information available to or provided by the user. They are not a medical assessment and may not account for all personal factors relevant to your health or safety.

You are responsible for ensuring that any information you provide to TrainEasy or enter into the app is accurate, current, and complete.

TrainEasy is not responsible for outcomes caused by inaccurate, incomplete, outdated, or misleading information provided by the user.

6. Assumption of Risk

You acknowledge that exercise, training, physical activity, and the use of fitness equipment or accessories carry inherent risks.

These risks may include, but are not limited to:

  • muscle soreness;
  • strains and sprains;
  • falls;
  • overexertion;
  • aggravation of existing injuries or conditions;
  • equipment-related injury;
  • serious injury; or
  • death.

You voluntarily assume the risks associated with your participation in exercise, training, physical activity, and use of the Services, except to the extent that liability cannot be excluded, restricted, or modified under applicable consumer protection laws.

You are responsible for deciding whether to start, continue, modify, or stop any exercise, activity, program, or product use.

7. No Guaranteed Results

Results vary from person to person.

TrainEasy does not guarantee that use of the Services will result in any particular outcome, including:

  • improved fitness;
  • improved strength;
  • improved performance;
  • weight loss;
  • body composition changes;
  • injury prevention;
  • pain reduction;
  • health improvements;
  • habit formation;
  • program completion; or
  • any other specific result.

Your results may depend on many factors outside TrainEasy’s control, including consistency, effort, genetics, sleep, nutrition, health status, medical history, training history, lifestyle, environment, and adherence to instructions.

Any examples, testimonials, progress indicators, estimated results, or user experiences shown by TrainEasy are illustrative only and should not be interpreted as a guarantee that you will achieve the same or similar results.

8. Physical Products

Any physical fitness products, accessories, or equipment supplied or promoted by TrainEasy must be used only for their intended purpose and in accordance with any instructions, warnings, specifications, or safety information provided.

You are responsible for checking each product before use and ensuring it is suitable for your intended activity, environment, and fitness level.

You should stop using any product immediately if it appears damaged, faulty, unsafe, unstable, worn, or unsuitable for use.

Do not use a product if you do not understand how to use it safely.

9. Third-Party Platforms, Devices, and Services

The TrainEasy app and Services may rely on or interact with third-party platforms, app stores, payment processors, mobile devices, operating systems, internet connections, wearable devices, analytics tools, or external services.

TrainEasy is not responsible for interruptions, errors, delays, incompatibility, data loss, device issues, platform restrictions, or service failures caused by third-party platforms, devices, software, networks, or services, except to the extent required by applicable consumer protection laws.

Your use of third-party platforms, app stores, devices, software, or services may also be subject to separate terms, policies, fees, and conditions imposed by those third parties.

10. Limitation of Liability

To the maximum extent permitted by law, TrainEasy is not liable for any injury, loss, damage, claim, cost, or expense arising from or related to:

  • your use or misuse of the TrainEasy app;
  • your use or misuse of any TrainEasy product;
  • your participation in exercise, training, workouts, or physical activity;
  • your failure to follow instructions, warnings, or safety guidance;
  • your reliance on any content, program, recommendation, or information provided through the Services;
  • your failure to seek professional medical advice where appropriate;
  • your use of the Services despite a medical condition, injury, limitation, or health concern;
  • inaccurate, incomplete, or misleading information provided by you;
  • third-party platforms, devices, networks, software, or services; or
  • any conduct outside TrainEasy’s reasonable control.

Nothing in this Disclaimer limits or excludes any liability that cannot be lawfully limited or excluded, including any rights or remedies you may have under applicable consumer protection laws.

11. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless TrainEasy and its directors, officers, employees, contractors, agents, and affiliates from and against any claims, liabilities, losses, damages, costs, and expenses, including reasonable legal fees, arising from or related to:

  • your misuse of the Services;
  • your breach of this Disclaimer;
  • your breach of TrainEasy’s Terms, policies, or instructions;
  • your unlawful, negligent, reckless, or wilful conduct;
  • your violation of any law or third-party rights; or
  • any information, content, or material you provide that is inaccurate, misleading, unlawful, or infringes another person’s rights.

This indemnity does not apply to the extent that the relevant claim, liability, loss, damage, cost, or expense is caused by TrainEasy’s breach of law, negligence, wilful misconduct, or breach of any non-excludable consumer guarantee or mandatory legal obligation.

12. Suspension or Termination of Access

TrainEasy may suspend, restrict, or terminate access to the app or Services, including accounts or access to features, where TrainEasy reasonably believes that:

  • there has been misuse of the Services;
  • there has been unsafe conduct;
  • there has been fraud, abuse, or unlawful activity;
  • there has been a breach of this Disclaimer, TrainEasy’s Terms, or any other TrainEasy policy;
  • continued access may create a safety, legal, operational, or security risk; or
  • TrainEasy is required to do so by law or by a third-party platform provider.

Where required by applicable consumer protection laws, TrainEasy will exercise this right in a fair and reasonable manner.

13. Emergency Situations

The Services are not intended for emergency use.

If you believe you are experiencing a medical emergency or urgent health issue, stop using the Services and contact emergency services or a qualified healthcare professional immediately.

14. Changes to this Disclaimer

TrainEasy may update this Disclaimer from time to time.

Any changes will take effect when the updated Disclaimer is posted on TrainEasy’s website, in the TrainEasy app, or otherwise made available to users, unless otherwise stated.

Your continued use of the Services after the updated Disclaimer is made available means you accept the updated Disclaimer.
