Disclaimer (WorkoutMate App + TrainEasy Products & Supplements)

This Disclaimer applies to all TrainEasy Pty Ltd (“TrainEasy”, “we”, “us”, “our”) offerings, including:

  • the WorkoutMate mobile application (the “App”); and

  • any physical products, fitness accessories, equipment, and nutritional supplements sold or promoted via the TrainEasy website/store or otherwise (the “Products”),

(together, the “Services”).

By using the App, purchasing or using any Products, or otherwise accessing the Services, you acknowledge that you have read and understood this Disclaimer and agree to its terms. If you do not agree, do not use the Services.

1) Recreational / General Use Only (Not Medical or Therapeutic)

1.1 Recreational purpose. The Services are intended for recreational and general fitness purposes only. The Products are not medical devices and are not intended for therapeutic, diagnostic, or medicinal purposes.

1.2 Not medical advice. Any information, content, programs, instructions, guides, labels, descriptions, or materials provided through the Services (including the App, the Site, packaging, marketing, emails, or customer support) are for general informational purposes only and do not constitute medical advice.

2) Use with Discretion

2.1 Individual health. Your health and physical condition are unique. Before using the App or any Products (including supplements), consider your personal health status, medical history, and any existing injuries or conditions.

2.2 Consult a healthcare professional. You should consult a qualified healthcare professional before:

  • starting any new exercise program;

  • using supplements; or

  • using any fitness product in a way that may affect your health,

especially if you have underlying health concerns, are pregnant or nursing, are under 18, or are taking any medications.

2.3 Follow directions and safety precautions. Do not modify, misuse, or disregard safety precautions. Always follow instructions, label directions, warnings, and recommended use guidelines provided with the App or Products.

2.4 Stop if adverse effects occur. Some individuals may experience discomfort or adverse reactions when exercising or using products or supplements. If you experience any adverse effects, stop immediately and seek medical advice where appropriate.

3) Assumption of Risk

3.1 Exercise and physical activity risks. You acknowledge that physical activity carries inherent risks, including the risk of serious injury or death. You voluntarily assume all risks associated with your participation in exercise, training, and physical activity, whether guided by the App or otherwise.

3.2 Product and supplement risks. You voluntarily assume all risks associated with the purchase, use, misuse, or inability to use any Products, including supplements, except to the extent such liability cannot be excluded under applicable consumer law.

3.3 No guarantees. Results vary by individual. We do not guarantee any specific fitness, performance, or health outcome from use of the App, Products, or supplements.

4) Limitation of Liability

To the maximum extent permitted by law, TrainEasy Pty Ltd is not liable for any injuries, damages, losses, or claims arising from or related to:

  • use or misuse of the App or any exercise guidance;

  • participation in physical activity;

  • purchase, use, misuse, or inability to use Products (including supplements); or

  • reliance on any content or information provided through the Services,

except to the extent liability cannot be excluded under applicable consumer law (including Australian Consumer Law).

5) Indemnification

You agree to indemnify and hold harmless TrainEasy Pty Ltd and its directors, officers, employees, contractors, and affiliates from any claims, liabilities, losses, damages, and expenses (including reasonable legal fees) arising from or related to your misuse of the Services, breach of this Disclaimer, or violation of any law or third-party rights.

6) Suspension / Termination of Access

We may suspend or terminate access to the App or Services (including accounts or access to features) where we reasonably believe there has been misuse, unsafe conduct, fraud, or a breach of our Terms or policies.
