Terms of service

These Terms of Service ("Terms") govern your access to and use of the TrainEasy mobile application, website, online store, digital delivery pages, claim pages, app-link pages, products, content, tools, and related services (together, the "Services").

The Services are operated by TrainEasy Pty Ltd ("TrainEasy", "we", "us", or "our").

By accessing or using the Services, creating an account, subscribing, purchasing a product, claiming an offer, uploading content, or otherwise using any part of the Services, you agree to these Terms and any policies referenced in them, including our Privacy Policy, Refund Policy, Shipping Policy, Warranty Policy, Disclaimer, and any offer-specific terms that apply.

If you do not agree to these Terms, you must not use the Services.

1. Eligibility

You may use the Services only if you can legally enter into these Terms.

If you are under 18, you must have permission from a parent or legal guardian to use the Services. If you are a parent or guardian allowing a minor to use the Services, you are responsible for that minor's use of the Services and compliance with these Terms.

2. Accounts

Some features require an account.

You agree to provide accurate, current, and complete information and to keep your account information updated.

You are responsible for maintaining the confidentiality of your login details and for all activity under your account. You must notify us promptly if you suspect unauthorized access to your account.

We may refuse, suspend, restrict, or terminate access to the Services if we reasonably believe that:

  • you have breached these Terms;
  • your account has been used for fraud, abuse, or unlawful activity;
  • your use creates risk for TrainEasy, other users, or the Services;
  • we are required to do so by law or by an app store, payment provider, or platform provider.

3. Licence to Use the Services

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal fitness, training, and related purposes.

You must not:

  • copy, modify, distribute, sell, lease, or sublicense the Services except as expressly allowed;
  • reverse engineer, decompile, or attempt to extract source code except where law allows;
  • interfere with, disrupt, overload, or bypass security or access controls;
  • scrape, harvest, or extract data from the Services except through features we provide;
  • use the Services for unlawful, harmful, misleading, abusive, or fraudulent purposes;
  • upload malicious code, spam, or content that infringes the rights of others.

4. Health, Fitness, and Exercise Disclaimer

TrainEasy provides fitness, training, workout, progress tracking, and related tools. The Services do not provide medical advice, diagnosis, treatment, rehabilitation, or professional healthcare services.

You are responsible for deciding whether exercises, workouts, training programs, Smart Progression recommendations, AI-generated outputs, health sync features, or other content are appropriate for you.

Before starting or changing any exercise or training program, you should consult a qualified medical or fitness professional, especially if you have a medical condition, injury, disability, pregnancy, or other health concern.

Exercise involves risk, including injury, illness, overtraining, and, in rare cases, death. You use the Services at your own risk. Stop exercising and seek medical help if you experience pain, dizziness, shortness of breath, faintness, or other concerning symptoms.

Additional disclaimers, product labels, warnings, instructions, and safety information made available on the Services or with physical products also apply.

5. Smart Progression and Recommendations

The Services may include Smart Progression, automated recommendations, training suggestions, goal-based prompts, and progress insights.

These features may use your workout history, body measurement data, training preferences, goals, and other app data to suggest changes to workouts or programs.

Smart Progression and similar recommendations are informational tools only. They may be incomplete, inaccurate, unsuitable, or based on limited data. You are responsible for reviewing and adjusting recommendations before following them.

6. AI Upload and AI-Generated Output

AI Upload may allow you to upload documents, spreadsheets, images, or other supported files so TrainEasy can help convert them into workouts, programs, exercises, or related training information.

AI Upload is processed by TrainEasy and by AI service providers. By using AI Upload, you confirm that:

  • you have the right to upload the content;
  • the content does not infringe another person's rights;
  • the content does not contain confidential third-party information you are not authorized to share;
  • you will not upload medical records, government identifiers, payment card details, passwords, or other high-risk sensitive information;
  • you will review and verify all generated output before relying on it.

AI-generated output may be inaccurate, incomplete, unsafe, or unsuitable for your circumstances. TrainEasy is not responsible for decisions you make based on AI-generated output.

We may reject, limit, cancel, or remove AI Uploads if needed for safety, security, policy compliance, abuse prevention, technical reasons, or legal reasons.

7. Health Sync

The Services may allow you to connect with Apple Health, Health Connect, or another supported health platform.

Based on the current app configuration, TrainEasy may read Apple Health weight, BMI, and height, and may write weight and BMI entries to Apple Health. On Android, TrainEasy may request Health Connect permissions for weight and height, including permission to write weight where supported.

Health Sync is optional. You control permissions through your device, health platform, and app settings.

You are responsible for checking synced data for accuracy. TrainEasy is not responsible for errors, delays, missing data, or platform changes caused by Apple Health, Health Connect, your device, or other third-party services.

8. Subscriptions, Paid Features, and Access

Some features may require payment, subscription, purchase, claim, promotion, or other access grant.

Paid or gated features may include, depending on the current offer and configuration:

  • TrainEasy Elite, premium, or advanced features;
  • Store content, workouts, programs, and previews;
  • Smart Progression, long-term analytics, advanced tools, or AI Upload capacity;
  • digital products, delivery pages, claim links, or promo wallet benefits;
  • other features described in the app, store, claim page, or offer terms.

Feature availability, pricing, trial terms, renewals, cancellation rules, and refund rules may depend on the app store, subscription provider, ecommerce provider, payment processor, promotion, jurisdiction, or offer terms.

Subscriptions may renew automatically unless cancelled according to the relevant app store or subscription provider rules. Deleting the app or deleting your account does not automatically cancel a subscription.

You are responsible for cancelling subscriptions through the relevant app store or provider before renewal if you do not want to be charged.

9. Promo Claims, Claim Links, and Offers

The Services may allow you to claim promotions, redeem links, receive Store access, receive subscription-related benefits, or add offers to a Promo Wallet.

Offers may be subject to eligibility rules, expiry dates, usage limits, campaign rules, country or account restrictions, fraud checks, access checks, and other conditions.

We may refuse, revoke, limit, or adjust claims, grants, discounts, or access if we reasonably believe there has been fraud, abuse, error, duplication, ineligibility, security risk, or breach of these Terms.

Claim links may be personal to you or transferable depending on the offer. You are responsible for how you use and share claim links.

10. Digital Products and Digital Delivery

The Services may provide digital products, downloads, store items, programs, workouts, or other digital content.

Digital delivery may be provided through app features, delivery pages, claim links, email links, or other supported delivery methods.

Digital products may be subject to download limits, expiry dates, access requirements, account requirements, or other feature rules.

You must not share, resell, redistribute, copy, or make digital products available to others except where the Services expressly allow sharing.

11. Physical Products and Store Orders

The TrainEasy website or online store may offer physical products such as training accessories, including Bench Buddy where offered, and other related products.

Product descriptions, images, specifications, prices, availability, shipping estimates, and other product information are provided for general information and may change without notice. We may correct errors, inaccuracies, or omissions and may cancel, refuse, or limit orders where needed because of pricing errors, stock availability, fraud checks, payment issues, legal restrictions, shipping limitations, or operational reasons.

You are responsible for providing accurate order, payment, delivery, and contact information. Order processing, payment, shipping, tax, fulfillment, and delivery may be handled by third-party providers such as ecommerce providers, payment processors, carriers, or fulfillment partners.

Physical products must be used responsibly, for their intended purpose, and in line with any product instructions, warnings, or safety information. You should inspect products before use and stop using a product if it appears damaged, unsafe, or unsuitable for you.

Refunds, returns, exchanges, cancellations, chargebacks, shipping, delivery, and warranty matters are handled under the applicable Refund Policy, Shipping Policy, Warranty Policy, product terms, offer terms, and applicable consumer laws. Nothing in these Terms limits rights that cannot be excluded under applicable law, including any rights under the Australian Consumer Law.

12. User Content

"User Content" means content you submit, upload, store, generate, import, share, or make available through the Services, including workouts, programs, custom exercises, notes, images, progress photos, AI Upload source files, AI-generated outputs, shared content, and related material.

You retain ownership of your User Content, subject to the rights you grant us in these Terms.

You grant TrainEasy a worldwide, non-exclusive, royalty-free licence to host, store, process, copy, modify, display, transmit, analyze, and use your User Content as needed to provide, operate, improve, secure, and support the Services and to comply with law.

You confirm that:

  • you have the rights needed to submit and use your User Content;
  • your User Content does not infringe any third-party rights;
  • your User Content is not unlawful, harmful, abusive, misleading, defamatory, obscene, or otherwise inappropriate;
  • your User Content does not contain malware or harmful code.

We may remove, restrict, or disable User Content if we reasonably believe it breaches these Terms, creates risk, infringes rights, or is required by law.

13. Sharing Features

The Services may allow you to share workouts, programs, store items, claim links, delivery links, or other content.

When you share content or a link, other people may be able to open, preview, save, download, redeem, or use that content depending on the applicable feature rules.

If you revoke a share or claim link, future access may be blocked, but copies already saved, downloaded, imported, redeemed, or otherwise obtained by another user may remain available to that user.

Do not share content unless you have the right to share it and are comfortable with recipients accessing it.

14. Intellectual Property

The Services, including software, design, names, logos, trademarks, content, templates, reference data, exercises, programs, Store content, and other materials, are owned by TrainEasy or our licensors and are protected by intellectual property laws.

Except for the limited licence granted to you under these Terms, no rights are transferred to you.

You must not use TrainEasy names, logos, trademarks, branding, product names, including Bench Buddy where applicable, or content without our prior written permission except where law allows.

15. Third-Party Services

The Services may depend on or link to third-party services, including app stores, health platforms, AI service providers, subscription providers, ecommerce providers, payment processors, analytics providers, diagnostics providers, email providers, support tools, carriers, and websites.

Third-party services are governed by their own terms and policies. We are not responsible for third-party services, outages, changes, errors, data practices, or content.

16. Privacy

Our Privacy Policy explains how we collect, use, store, share, retain, and protect personal information.

By using the Services, you agree to our Privacy Policy.

17. Availability, Changes, and Beta Features

We may modify, suspend, remove, limit, or discontinue any part of the Services at any time, including features, content, offers, pricing, access rules, AI Upload capacity, Smart Progression behavior, sharing behavior, Store availability, or digital delivery methods.

Some features may be experimental, beta, region-limited, invite-only, or subject to rollout controls. We do not guarantee that any feature will always be available or remain unchanged.

18. Warranties and Consumer Rights

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.

We do not warrant that the Services will be uninterrupted, error-free, secure, accurate, complete, or suitable for your goals or health circumstances.

Nothing in these Terms excludes, restricts, or modifies rights that cannot be excluded under applicable law, including any rights you may have under the Australian Consumer Law or other consumer protection laws.

19. Limitation of Liability

To the maximum extent permitted by law, TrainEasy and our directors, officers, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity.

To the maximum extent permitted by law, our total liability arising out of or relating to the Services or these Terms is limited to the amount you paid to TrainEasy for the relevant Service in the 12 months before the event giving rise to the claim.

This limitation does not apply where liability cannot be limited by law.

20. Indemnity

You agree to indemnify and hold harmless TrainEasy and our directors, officers, employees, contractors, affiliates, service providers, and licensors from claims, losses, liabilities, damages, costs, and expenses arising from:

  • your use of the Services;
  • your breach of these Terms;
  • your User Content;
  • your violation of law or third-party rights;
  • your misuse of sharing, claim, promo, AI Upload, health sync, or digital delivery features.

21. Termination

You may stop using the Services at any time. You may request account deletion as described in the Privacy Policy.

We may suspend, restrict, or terminate your access if we reasonably believe that you breached these Terms, created risk, misused the Services, failed to pay, engaged in fraud or abuse, or if we are required to do so by law or a platform provider.

After termination, sections that by their nature should continue will continue, including sections about intellectual property, User Content licences needed for prior operation, payments, disclaimers, liability, indemnity, privacy, and dispute-related provisions.

22. Governing Law

These Terms are governed by the laws of the Australian Capital Territory, Australia, except where mandatory local law gives you rights that cannot be waived.

You agree to submit to the courts of the Australian Capital Territory, Australia for disputes arising out of or relating to these Terms or the Services, except where applicable law gives you a right to bring claims elsewhere.

23. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as by updating the policy page, changing the effective date, or asking you to review and accept updated terms in the app where appropriate.

Your continued use of the Services after updated Terms take effect means you accept the updated Terms.
